Rats are among latest problems at Sunset Garden apartments in town of Ulster

Town of Ulster Code Enforcement Officer Kathy Moniz said the latest problems will be the subject of a Jan. 7 hearing in Town Court.

“We’re going to ... try and get an order from the judge to get this taken care of,” she said Tuesday.

Moniz said the rat problem dates to this past August and the railing problem dates to June. She said efforts by the apartment complex owner to fix the railing have been insufficient.

"They put up a handrail that was almost right against the building and didn’t go to what they call the 'return,' so ... it’s not to code,” she s...id.

Sunset Garden, off Boice's Lane in Ulster, is owned by Sunset Gardens LG Associates and operated by E&M Management.

The same ownership/management team also controls the Stony Run apartment complex on Hurley Avenue in the city of Kingston and the problem-plagued Lakeshore Villas complex off Route 9W in the town of Esopus.

Sunset Garden comprises 217 apartments spread across 19 buildings. The current violations are in a single building, Moniz said.

Sunset Garden Property Manager Jennifer Sparling said the railing has been fixed and a visit by an exterminator been scheduled to deal with the rats.

“They are doing a building that had an issue tomorrow,” Sparling said Tuesday, “... and then they’re doing each individual building in two different visits.”

Moniz on Tuesday questioned the timing of the exterminator’s visit, saying she had asked to be on site when the work was being done and was told it would be next week.

Earlier this year, Sunset Garden was served with violation notices in March for heating outages in two buildings and in May for failing to address sewage backups.

The 152-unit Lakeshore Villas complex has been cited this for failing to maintain plumbing fixtures, inspect fire extinguishers, remove trash and debris from common areas, maintain means of egress, maintain fire-resistance ratings, maintain clothes drier exhausts, and maintain decks and walkways.
